Blue Diamond Cre8tive ("we", "us", "our") uses artificial intelligence as part of how we produce marketing content, campaigns, competitor research, and Academy materials. By using our services, tools, or products, you agree to be bound by the terms of this Disclaimer & Indemnity.

1. Nature of Service

Blue Diamond Cre8tive's outputs are provided for informational and decision-support purposes only. Artificial intelligence can make errors. Always verify with a qualified professional before taking action. This applies to every deliverable we produce, including content drafts, campaign copy, competitor research entries, and Academy course materials. Nothing we produce constitutes legal, financial, tax, or investment advice.

Our services are designed to produce structured, useful marketing output, reviewed by our team before delivery, not final documents that should be used without your own judgment and, where relevant, independent professional review.

2. Artificial Intelligence Limitations

We use AI as part of our production pipeline. Despite careful design and human review, AI is subject to known and inherent limitations, including:

• Hallucination: AI may generate plausible-sounding but factually incorrect claims, statistics, or competitor data.
• Contextual misunderstanding: AI may misinterpret the specific facts of your brand, market, or audience.
• Temporal obsolescence: AI training data has a knowledge cutoff and may not reflect recent market conditions, platform rules, or advertising policy.
• Incomplete context: AI works only with the information provided to it and cannot independently verify the accuracy of inputs you or we have not confirmed.

Errors are possible and occur despite precautions. No AI system is infallible, and every AI-assisted draft we produce is reviewed by our team before it reaches you.

2.1 Competitor Intelligence Vault output

Vault entries, weekly scans, and monthly white-space reviews reflect research available to us at the time of entry and our interpretation of it. They are not a guarantee of a competitor's actual pricing, strategy, or intent, and should be treated as directional intelligence, not verified fact. Vault entries are currently sourced from manual, internal research rather than automated scraping, pending a legal review of target sites' terms of service.

3. Your Responsibility for Verification

You are responsible for reviewing all output we provide, and for verifying anything with legal, financial, or regulatory consequences with a qualified professional before acting on it. This includes, without limitation:

• Any advertising claim, comparison, or statistic we draft, before it is published
• Any competitor pricing or positioning data from the Vault, before you act on it commercially
• Any content touching regulated topics (health, finance, legal services) in your industry

The fact that we produced or delivered a piece of content does not mean it is correct, complete, or appropriate for your specific circumstances without your own review.

4. No Warranty

Blue Diamond Cre8tive is provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to:

• Warranties of accuracy or completeness
• Warranties of fitness for a particular purpose
• Warranties of specific marketing results, engagement, or revenue outcomes
• Warranties of uninterrupted or error-free service

Blue Diamond Capital Ltd makes no representations that any deliverable will be free from errors or that our platform is free from viruses or other harmful components.

5. Indemnity

If you take any action based wholly or partly on our output, including publishing content, launching a campaign, or making a business decision informed by Vault data, you do so at your own risk.

You hereby indemnify and hold harmless Blue Diamond Capital Ltd, its directors, officers, employees, agents, shareholders, and affiliates (collectively, "the Indemnified Parties") from and against any and all:

• Losses, damages, claims, and liabilities of any nature
• Costs and expenses, including legal fees on an attorney-and-own-client scale
• Consequential, indirect, or economic loss arising from reliance on our output
• Any action you take, or fail to take, based on our output
• Any error, omission, or misstatement in the output we provide

This indemnity survives the termination of your use of Blue Diamond Cre8tive and applies regardless of whether the Indemnified Parties were negligent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Blue Diamond Capital Ltd shall not be liable to you or any third party for any:

• Indirect, incidental, special, or consequential damages
• Punitive or exemplary damages
• Loss of profit, revenue, or anticipated marketing results
• Loss of business opportunity or goodwill

arising from or in connection with your use of, or inability to use, Blue Diamond Cre8tive, even if advised of the possibility of such damages.

Where liability cannot be excluded by law, our aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.

7. Professional Advice Exclusion

Nothing we produce, including any content, strategy, research, or recommendation, constitutes professional advice of any kind. Specifically:

• No output constitutes legal advice.
• No output constitutes financial, tax, or investment advice.
• No output constitutes a guarantee of compliance with advertising, data-protection, or industry-specific regulation in your jurisdiction.

8. Compliance with Law

We do not guarantee that any deliverable complies with any applicable statutory or regulatory requirement in your jurisdiction. This is your responsibility to verify.

9. Governing Law and Jurisdiction

This Disclaimer & Indemnity is governed by the laws of the Republic of Mauritius. Any disputes arising from or in connection with this disclaimer shall be subject to the exclusive jurisdiction of the courts of the Republic of Mauritius.
